In your second bulletpoint under 3, the crucial thing is that our agreements say that we MAY attach a covenant, but are not obliged to. The relevant section of the Further Terms of Sale 27.1 reads"The Vendor may grant or receive the benefit of any easements, land covenants, rights, obligations, consent notices or bonds over the Property and/or over the land of which the Property forms part ..."
