I will finalise that drafting and get that through to you early next week. You will see that we have been having some major issues and delays with the valuer and what LINZ have required him to correct but hopefully we are now there. It has been very frustrating to say the least. That is good news about practical completion and CCC which now looks close. We would still expect that we will have new titles issued well before CCC is issued. Our contact at LINZ has been very helpful and it is being fast tracked for us. The draft letter regarding Unit C1 and the possible default looks all ok. The process in the situation of a default is that a settlement notice is served under the process in clause 11.0 of the Agreement and the purchaser then has 12 working days in which to settle after which the Agreement can be cancelled and the Unit resold. Any shortfall in the price on resale can be recovered from the defaulting Purchaser (unlikely given the likely increase in any sale price). Usually the deposit would also have to be forfeited by the purchaser but in this case it is a loan rather than a true deposit. Thought will need to be given as to whether you would intend to repay that back to a purchaser on default or argue to retain it if possible. Hoggin Paving and Solutions

Hi everybody. I have seen a few emails and comments about the hoggin paving. Let's remember that the design team proposed the hoggin paving and that the group accepted it going all the way to our back doorsteps. We have nothing to say to SW about this. We like it or not, we have instructed them to do so. We might not be happy with the final result but it was our decision and they only followed our instructions and specifications. We could have asked for a sample but we didn't, so now we need to live with it. We also need to remember, as Tim pointed out, that the group decided not to have access at level with the units to reduce costs as this included expensive channels at every back doorstep. It was our decision to do that. The levels are not perfect (in my view) but they are not the end of the world either. They also vary from house to house. SOLUTIONS/SOLUTIONS! We can easily build our paths by placing pavers or stones in our private back yards to access our back doorsteps. This would create a clean area to walk through (about 4 metres of path) with the added benefit of raising the level at our doorstep by around 30/50mm where needed potentially achieving the ideal 150/180mm doorstep at our back doors. We have placed two pavers at our stairs D5/D6 and you can clearly see how this would work fine. At this stage, we need to finish this project, we are very close. Let's start working on our paths/planting over the weekend! I also want to point out that ALL units have a hard surface entrance alternative: A units, H units, C units M1& M2 have front concrete pads and the D units have concrete balconies. Only M3 has no other alternative but the hoggin paving to access. And let's also remember how lucky we are to have our units completed. They might not be perfect but nothing is, let's look at all the positives aspects of the project and let's start building our paths/gardens. Toiora High Street Cohousing Agreement - Final draft?

Hi Cohousers, Here is the Toiora High Street Cohousing Agreement in its current form. We have read and discussed and edited every part - except for 'Dispute Resolution and Mediation' on page 7, where we are waiting for professional input. Please consider whether the Agreement is now 'good enough' to be able fulfil its role as a guide to living together for the next few months or so. There will inevitably be numerous issues that are unforeseen as the community starts its life in close proximity in a fresh and exciting built environment. Those issues can be addressed as they arise and if necessary be added to, or amended in, the Agreement. Please send comments on punctuation, grammar, and consistency to me and I will edit as required. Comments on outstanding issues or misgivings should be saved for the next regular meeting. I'm sorry if I have upset you Marianne, you will know I have no reason to want to do that and am sorry if I did. The mention of non-responce of others was just to alert those who had signalled an interest in a meeting next Sunday that it would be premature to box on with it unless it suited all interested members. That's why I sent it to shareholders address. It certainly was not intended as a rebuke. Anyway, Donald has said clearly that he thinks it would be best to delay till we are all in residence and that may be the best thing to do. Also, to make sure we are all on the same page, I do not particularly want to take any role in this, I was just conscious of the vacuum. Pity the weather has turned, but isn't the cup becoming exciting! Work groups

Just a few thoughts about work groups . . . I've seen a few emails where people are suggesting starting - or maybe have started - sub-groups. Gay's earlier email suggested there were up to 5 gardening sub-groups! And I have heard of a group concentrating specifically on the Lounge Area in the Commonhouse. In my view, subgroups that branch out have the potential to get messy as they could well take action at odds with other subgroups. It's OK for people to have specific areas of interest and/or skill, but it all seems to be issue-driven currently. I suggest that everyone take a look at the Work Groups that are already identified in our Cohousing Agreement, and start with that as an initial structure. Each 'base' Work Group can then give approval for a smaller group to act within a certain scope. Otherwise it's a bit like cherry-picking the best bits of a Work Group's responsibilities and no-one will want to do the hard or mundane tasks . . . perhaps. Over time the Work Groups will naturally evolve, but they should still receive the oversight of The Group to ensure that everyone remains happy, and not surprised by developments. BTW, the edited Agreement is about a day away. Cheers Warren

A few of us have been talking about another garden group meeting to begin coordination of all landscape planning, execution and maintenance tasks – in other words to create what Robin Allison would call a "focus group” . Currently, we seem to have several sub groups: – a Vegetable Gardening group led by Donald and Miriam, – a Garden Tools Group led by (I think) Ngaire, – a Lawn-establishing Group led by (I think) Anthony, – a children’s and young persons area, led by (I think) Jessica, Some people have expressed interest in being part of the Heritage Fence Group. But an overall Grounds Group would establish and coordinate subgroups for things ranging from important as design to as mundane as the rubbish. (Re design, Maria has signalled an interest in being part of this but not leading it.) Does anyone have any thoughts about how best to establish this? Min, Jessica, Pip, Ngaire and I can all attend a meeting this Sunday to get things underway, but’s there has been a bit of a silence from others who are in the Whats App Gardening Group. Can you please let me know who will be on duty at the Common House next Saturday, 20 March, and from what time We have arranged for a carpet layer to come and lay out the carpets and then give us a quote for fitting them.
